ACKNOWLEDGEMENT AND AGREEMENT

I have received an electronic copy of the current Baker College Employee Handbook, will review the policies described in the Handbook and agree to abide by them as a condition of employment.

I understand that I have an obligation to disclose any conflict of interest that I may have. Annually, employees are required to acknowledge the Conflicts of Interest policy.

I understand that I have reviewed my current job description and agree to my description of duties.

I have reviewed and understand the Outside Employment Policy in the Employee Handbook and agree to follow the conditions listed in said policy.

I understand that the Baker College Employee Handbook does not represent a contract of employment, but rather provides guidelines and explanations regarding Baker College’s policies and procedures.

I acknowledge that no representative of Baker College has promised me employment for any definite period of time, and that no one is authorized to make such promises to me or to change the at-will nature of my employment unless in a writing entitled “Employment Agreement” and signed by the Campus President and Vice President of Human Resources. I understand that at all times my employment relationship with the College may be terminated at will, with or without cause and with or without notice.

I understand that the policies and benefits described in the Baker College Employee Handbook may be changed from time to time at the sole discretion of the College and the changes will become effective upon reasonable notice.

I understand that if any policy or procedure in the Baker College Employee Handbook conflicts with any federal or state law, the law will apply.

I agree that, to the extent permitted by law, any action or suit against Baker College or related entities (or any of its or their employees, officers, directors or representatives), which arises out of my employment or termination, including, but not limited to, claims arising under state or federal civil rights statutes, must be brought within 180 days of the event giving rise to the claim or be forever barred. This applies to the initial filing of a charge with the Equal Employment Opportunity Commission; however, thereafter I am permitted to pursue litigation, if at all, as explained in the Commission’s “Right to Sue” letter. I waive any longer, but not shorter, limitations periods to the contrary.  If this contractual limitations period is found to be unlawful as to any claim asserted, a court of competent jurisdiction shall have the right to amend it to the extent required by law, and apply it to the remaining claims so as to give effect to the intention of this provision.
